WHY DO YOU NEED
AN AUTHORISED
REPRESENTATIVE?

Under the PPWR, two types of Authorised Representatives (ARs) exist, with distinct roles:

Authorised Representative for Packaging Design Conformity

Manufacturers (established in or outside the EU) may appoint one EU-based Authorised Representative to fulfil the sustainability and labelling requirements in Article 5-12 of the PPWR.

This AR ensures compliance with packaging design requirements across the EU, acting as the single point of contact for all market surveillance authorities in the EU.

Responsibilities of the AR include:

  • Holding the EU Declaration of Conformity and technical documentation for:
    • 5 years (for single-use packaging)
    • 10 years (for reusable packaging)
  • Cooperating with national market surveillance authorities in case of request
  • Making all necessary documentation available within 10 days
  • Providing information in a language easily understood by the competent authority

Authorised representative(s) for EPR

EU-based producers making available for the first time packaging or packaged products to household and professional end users in other Member States must appoint a national Authorised Representative (AR) in these countries.

For non-EU-based producers making available packaging or packaged products to household and professional end users, the requirement to appoint an AR depends on the national transposition of the PPWR in each Member State.

This AR ensures EPR compliance by acting on behalf of the producer.

Responsibilities of the EPR AR include:

  • Registering with the national producer register
  • Reporting separately for each represented producer
  • Notifying the national register of any changes or permanent cessation of market activity
